What Constitutes Age Discrimination ?

Age discrimination at work place is the act of rejecting a job application or denying an opportunity because of the applicant’s age is called age discrimination. It may be a brand new job offer or an existing promotion or a job within the company that the applicant could have been eligible for.

Age discrimination at work place has become very common, and with the growing population of the baby boomers more and more seniors are getting laid off by their employers. When a company is taking up cost cutting measures and is looking at down sizing, they first remove seniors from the jobs thinking that the younger people are more deserving and also easier to handle. When an employer hires a senior, their insurance costs and maintenance costs for the employee go up considerably. To avoid such issues, they usually avoid encouraging applications from seniors.

If a person irrespective of the gender, color and age has complete capability to perform the required tasks for the job, then he or she is considered as eligible for the said job. When the employer gives a list of requirements and the candidate possesses the skill sets, then they are eligible for the job. If the employer denies an opportunity, then it clearly amounts to age discrimination by the employer. Age discrimination can also occur in the society. For example, people get denied housing based on their age.

The Federal law condemns age discrimination and considers it to be a crime. However, despite the rules, age discrimination is present in the society by large.
