However, there are certain provisions within the law through which one can ease the financial anxieties associated with the emotional turbulence. One such provision is the equitable distribution law that has been adopted by many states in the US including Virginia. Equitable distribution law has been introduced with the objective of dividing marital property and debts in situations of divorce or marital conflict. As per this law, marriage is termed as an economic partnership that involves fair distribution of the marital property and debts. In order to achieve the objective of a fair distribution, it is important to classify property and debts into three different categories. These include marital, separate, and part marital and part separate. Depending on this, the marital property and debts should be valued and divided equitably based on the statutory factors. Explained below is a typical example where a divorce application has been filed based on equitable distribution law and the civil lawsuit is still pending.
Terry (Hulk Hogan) and Linda Bollea have a teenaged son named Nick Bollea, whose negligent drunken driving led to a very serious accident and the victim, John Graziano, and his family have filed a case against Nick. Immediately after this the media went berserk with this news and many people consider the divorce as a farce and as an attempt to preserve the family’s assets from the scrutiny of the upcoming civil suit to be filed by John Graziano’s family against their son Nick Bollea.
Kimberley Kohn, a Tampa attorney who represents Ed Graziano, the father of injured John Graziano stated that a divorce is the only option that can save the assets of the Bollea family by essentially halving them. If the vehicles involved in accident, Supra and Viper, are not found to be registered in the names of both the parents, then it could save them their assets. However, Kohn says that she will proceed with the lawsuit irrespective of the married status of the Bolleas and ensure that justice is meted out to her client in the pending civil lawsuit against Nick Bollea.
