The general criteria for obtaining this clean slate scheme are mentioned below:
- The individual should not have faced any conviction for the last seven years.
- The individual should not have been imprisoned, or should not have been ordered by a court during a criminal case to be detained in a hospital due to his or her mental condition, instead of being sentenced.
- The individual should not have been convicted of a "specified offence" (which includes a sexual offence against children and young people or the mentally impaired) during his entire lifetime.
- The individual should have fully paid any fine, reparation or costs ordered by the court in a criminal case.
- The individual should never have been indefinitely disqualified from driving under section 65 of the Land Transport Act.
A criminal record search is recommended to all the employers before they hire any new person. This activity helps in minimizing the risks involved. One also needs to validate the information furnished by the applicant and check the authenticity and credentials of the individual before absorbing him or her into the organization.
A criminal record search can be done country- or state-wise depending on the need. It is conducted for a minimum period of seven years. A country criminal search record provides the latest information about an individual. A state-wise search is beneficial if the individual has lived in several countries or if one is unsure of the country in which he has lived. However if one is looking for criminal records within six to twelve months, it is best to go in for a country criminal search.
