How Long Does A Misdemeanor Stay On Your Record ?

Misdemeanor is an act of crime which is considered less serious than an act of felony for which fine or jail term to the maximum tune of one year can be granted. These punishments are awarded by courts of police, justice or municipal offices and not by federal court. The mention of this act stays for lesser duration in some states while in the others, the mention remains forever. Most of the states allow certain exceptions for misdemeanors conducted by juveniles. The law permits removal of record of misdemeanor from their records in order to give them a fair chance for a good living in their adulthood.

In most of the states, an option called expungenment can be taken by the individual charged with misdemeanor. By this, the record of crime will be destroyed or kept away from public, which will permit the individual to quote lawfully that no charge of crime exists. Most states might have slight variations in the qualification of crimes and other terms with regard to expungenment. In general, if the individual has a mention of only one misdemeanor in the records which is not categorized under sexual offence, expungenment can be granted.

One should clearly understand the rules of the state in which the misdemeanor was done with regard to its expungenment. Expert advice can be sought from law practitioners who specialize in this field. One can take a copy of the crimerecord from the local police precinct. Excepting few charges like assault, most others can be wiped off from the personal records in many states.

One will have to fulfill all the requirements laid out for wiping clean the records of misdemeanor. Community service, jail term, payment of fine, misdemeanor probation, staying away from trouble for certain time span and so on are few remedial measures that the court may impose.

In some states, one can approach the court, fill a form and represent oneself in the court. Otherwise an attorney trained in expungenment can be hired to file the papers and represent the case. Either ways, one will have to make an appearance in court.

Fees for expungenment will have to be deposited following which the court will direct agencies to wipe out the record. It can take 6 months or even longer for the misdemeanor to be removed from your records. Following this, a new copy of one’s criminal record will have to be obtained and checked for absence of misdemeanor record. If it still exists, the court can be contacted for the same.

How To Get A Misdemeanor Dismissed ?      An arrest made on charges of misdemeanor will have to be tried in the court after the charge has been filed. In case of any delay, the Deputy Public Defender can be consulted to clarify if any charges will be filed at a later date. If yes, find out when the charges would be filed. The individual can surrender voluntarily in the court through the attorney whenever the charges are filed later. This action will reduce the possibility of the individual getting incarcerated during the arraignment when charges are filed against him or her. More..
