What Is A Class B Misdemeanor ?

Misdemeanor is a crime committed against a person, but the crime is not very serious as that of committing a murder or any other higher level of crime. Typically, a misdemeanor is classified into Class A, Class B and Class C. The offenders belonging to Class B misdemeanor is punished less when compared to Class A misdemeanor. For the Class B misdemeanor, usually imprisonment or fine or both are given as punishment. The fine collected from the offender varies with crime. If the crime is done in a very severe manner, then the fine may increase for Class B misdemeanor. The other causes for any increment or decrement of fine depend on the history, character of the offender, and the nature of the crime committed.

The law enacted by each state varies, and as the result, the punishment also varies with each area and jurisdiction. The extent of punishment depends on the law in that particular area. In some places, the misdemeanor may get less punishment for a crime compared to any other place. Class B misdemeanor usually gets an imprisonment period of one year or less than one year.

If the offender has done the crime for the first time and the crime happened unintentionally, then the accused may not be sent to the jail. In such a case, the offender may be given community service or put under house arrest for a specific period of time. Punishments like weekend imprisonment and charging the offender with fine also happens in some cases.

The crimes that fall under Class B misdemeanor are terrorist threats, malicious behavior, enticement especially of minors, physical attack, criminal trespass, stealing, prostitution, indecent exposure, inscribing indecent things on the walls, and drunk driving among others. When these kinds of crimes happen, the offenders are often arrested and if the crime is proved, then the offenders are punished based on the gravity of the crime.

Class B misdemeanors are not only fined, imprisoned, house arrested or engaged in community service, but also subjected to various other punishments like providing the offender with treatment program if the offender is drunk driver or suspending the driver’s license. It is quite commonly seen that if an individual has not repeated the same crime again and again, the punishment given is minimal. The sentence given becomes tougher when the same crime is repeated several times.
