Is Perjury A Crime Against The State ?

Perjury is viewed as a federal offense and in order for a person to be found guilty of perjury, certain criteria must be met. The person should have lied or made a false statement knowingly under oath, and the false statement should have a direct impact on a court case. Whether perjury is a crime against the state is debatable.

In order for perjury to be a crime against the state, the onus of bringing the charges against the perjurer lies with the state. In other words, the state should be one bringing the charges against the person, who has perjured. Furthermore, the state should prove without a doubt that the person committed perjury. At the same time, there is a law that is followed in some jurisdictions that does not allow the state to prosecute a criminal offender for perjury if the offender gives false testimony during the trial to defend himself or herself.

Hence, perjury is considered as a crime against the state only when the state is bringing perjury charges against the person, who has given false statement under oath.

Also, the perjury should be directly relevant to the ongoing court case. For instance, if a witness claims that he has 4 children when he has 5, it will not be considered perjury, as the witness’ children have no bearing to the case in question. However, if the number of children has a direct impact on the case, then the state can charge the person with perjury.
Usually, when a person is convicted of perjury, the penalty could be a fine, jail time not more than 5 years, or both. This is for a federal offense. However, the penalty for perjury against the state will vary based on the state law. When it comes to perjury, an individual cannot bring perjury charges against a person. The charges have to be brought by a prosecutor and hence, the person committing perjury has to be formally charged for it in the court of law. When a person is charged with perjury, he or she is accorded the same rights as other accused and the person also has a right to trial by a jury.
