Punishment For White Collar Crimes

White collar crime is a criminal offence which scares most defendants since the penalties levied are heavy. The insecurity of their future after leading a good lifestyle and probable conversion of the offence as a civil lawsuit makes the consequences worse when convicted. These lawsuits can be filed by offended victims, state or federal government. The sentence post civil case will be in addition to those awarded on criminal charges.

Criminal lawsuit will warrant sentences like prison term, monetary fine or both. The penalties are often very severe. The guidelines for such sentencing can vary from one state jurisdiction to another. Keeping uniformity of treating cases of similar nature at par, judges often ensure that the sentence for crime is uniform. The nature of the crime in hand and any previous record of crime are also taken note of. Sometimes, depending on the case, the judge may impose a punishment which might vary from that laid out in the guidelines.

The defendant may end up getting a suspended prison sentence, short term of jail than usual or probation depending on past criminal record. They can be charged fine, or instructed to give up profits or even pay restitution to the affected people. The decision to sentence the defendant to a term in a minimum security jail rests with the correctional authorities.

Those convicted of white collar crimes will not always get to serve a term in institutions with minimum security. If the case is transferred to civil court by the government, any profit earned by the defendant will be transferred to the government or ordered to be paid back to victims or for paying up for other damages . The defendant may be awarded ‘asset forfeiture’ in which any purchase made through the offence will be seized by the government.

The person facing charges of criminal or civil case of white collar offence or conviction will suffer from social stigma apart from facing difficulty in getting new employment since the previous conviction involves dishonesty and deceit. A person will not be able to retain to obtain professional license as well.

A non- American citizen may be awarded removal from the country or other immigration complications. A resident working in the US with a work permit and having a permanent residence lawfully will be removed from the country. Such a conviction will adversely affect the chances of obtaining permanent citizenship of the country.
