Can You Amend A Legal Separation To A Divorce ?

The rules for child support vary from state to state in the United States. In some states a divorced couple can amend a legal separation to a divorce but in some states they cannot. Instead of filing for divorce, several couples keep their options open by filing for legal separation. It is just like keeping a window of hope open so that if things work out in the future, then they can easily call of the separation.

Usually a divorce case will take the couple to a point of no return. Also several couples fall apart after legal separation. Some of the other reasons why couples chose legal separation is for religious reasons, financial and other alternative arrangements.

During the separation a couple can decide for a divorce at any given point of time. In case for some reason, according to the state laws, your divorce is facing road blocks then you can typically amend a separation to the divorce until it comes through. This typically happens when one of the spouses does not have a residency in state or other inevitable reasons. In such cases, separation should be amended if you wish to continue receiving your benefits.

A legal separation is same as a divorce in many ways. However, it does not spell the couple as individuals and would still consider them as married couple. For example, one of the spouses cannot marry while being legally separated whereas in a divorce it is possible. There are small rules like this which differentiate a separation and a divorce.
