Where To Get A Work Permit ?

The U.S. work permit can be obtained in 2 major ways -- (i) L1 Visa and (ii) H1B Visa. The L1 visa allows the U.S. employers to transfer employees from other countries into their U.S. offices. The primary pre-requisite of this visa is that the transferred employee must be a part of ant branch, affiliate, or subsidiary of the applicant company. L1 Visa for executives and managers is valid for 7 years. The family members of the transferred employee must apply for L2 Visa.

Thus, if you are working with a company, you can obtain the work permit under L1 visa via your company office in the U.S. The company can also apply at the BCIS service center for the same. Exchange students from foreign countries have very limited employment rights in the U.S and must apply for J1 Visa to study or work in the U.S.

On the other hand, an H1B visa is a visa that is occupation specialized and is obtained by the employers for a maximum of 6 years to be able to invite a stipulated number of employees to US each year. Thus, in order to get work permit under H1B visa, you must first find a job, wherein you will be issued an H1B visa by your employer, who will also be your sponsor. Once the visa is issued by the U.S government, you are eligible to migrate to the USA and begin working. Your immediate dependents get automatically sponsored under this visa. Thus, to get work permits, you must ask your employer in the U.S to sponsor you under either of these 2 visas. The applications need to be filled by the company and submitted to the INS office as per the usual visa application process.
