Can I Build A Fence On My Property Line ?

Many homeowners with kids and/or pets want to build a fence around their property to provide a safe play area for the kids or restrict the kids and pets from venturing out. When it comes to building a fence around a property, homeowners always ask: "Can I build a fence on my property line?"

Property line plays a vital role in demarcating one property from the neighboring properties. The line helps a homeowner to figure out where the boundaries of his or her property are. Once the boundaries are known, the homeowner can take up construction within the confines of the boundary or even planting of trees.

While it is perfectly alright to build a fence on a property line, experts recommend that the fence be build six inches inside the property line. (See Reference 2) This is to prevent any kind of dispute with the neighbors and to prevent neighbors from claiming that the fence is encroaching into their properties. In addition, every area will have its own zoning laws and based on those laws the fence would have to be built. On the other hand, if 2 neighbors agree to share the cost of the fence, then it can be built on the property line. In order to be safe, it is best to have the fence six inches inside the property line. If a person is unsure about where the property line exists, then he or she can have a professional surveyor determine the boundaries of the property. In addition, there are also underground utility locating companies that help with marking out underground lines present in a property. Even these companies can be contacted to mark the lines laid under the ground, especially those that a person feels are close to the property line.

Once you know where the property line exists, you should get in touch with the local municipality to find out the laws and regulations for building the fence. Most of them will stipulate that the fence cannot be constructed bang on the property line. Rather the fence would have to be constructed around six inches inside the property line. (See Reference 1) Also, the person would need to get the necessary permits to build the fence.

Before building the fence along the property line, a person should inform the neighbors who have adjoining properties. Any issues should be sorted out before the construction begins to avoid problems later on. (See Reference 1)
