How Far From Property Line Can You Park ?

Property line can be a bone of contention between neighbors. It can cause neighbors to fight with each other, especially when people build their garages close to the property line. So, it is not strange for people to ask how far from the property line can you park.

A person's property extends right up to the property line. Hence, the person has the right to park anywhere within the boundaries of his or her property line. So, even if a person parks at the property line, a next door neighbor cannot object to it. (See Reference 2) Unfortunately, even if a person parks his or her car at the property line and this line is close to the neighbor's window or door, there is nothing the neighbor can do to prevent the person from parking his or her car. (See Reference 2) However, the person cannot park in the neighbor's property. That is why it is important to determine where the property line is for each property.

In order to determine your property line, you can hire the services of a surveyor to figure out the markers for your property. This will set you back a few hundred dollars, but it will give you peace of mind and prevent disputes with your neighbor about you parking your car too close to the property line.

Another alternate is to purchase a metal detector or hire one and use it to scan the estimated boundary of your property. This will help you locate the pins embedded into the ground by the developer of the property. (See Reference 1) Once the pins are located, you will be able to figure out your property line and park car anywhere along your side of the property.

Go to the county's assessor's office and request for a plat map for your property. This map will allow you to figure out where the plat marker is installed and this will help you determine the boundaries of your property. Alternatively, start checking all the documents that you have about your property. Invariably, a person has a survey done before purchasing a home. There should be a copy of the survey. Otherwise, get in touch with the title company that helped close the house purchase. The company will have a copy of the property line along with the description of the property and the precise size of the lot. (See Reference 2)

Using one of these methods will help you determine your property line and ensure that your neighbor cannot question you when you park your car too close to it.

Laws About Tree Overhanging Property Line      Any tree that is at the boundary of 2 properties is called a boundary tree. (See Reference 1 and 2) In such a case, both neighbors are responsible for maintaining the tree. However, if most of the trunk is in one neighbor's property and beyond the property line, then that neighbor owns the tree and has the responsibility to maintain and prune the tree.
